EB-2 National Interest Waiver (NIW): The Three Dhanasar Prongs Explained

The EB-2 National Interest Waiver lets you file your own green card petition without a job offer or a PERM labor certification. USCIS grants it only when you meet the EB-2 baseline and prove all three Dhanasar prongs by a preponderance of the evidence.

What the NIW Is

The NIW is a waiver inside the second preference (EB-2) category. The USCIS Policy Manual states that the waiver applies only to EB-2 applicants. Those are members of the professions with an advanced degree, and people with exceptional ability. A waived job offer also waives the labor certification, so you can self-petition on Form I-140.

The legal test comes from Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016). That decision replaced the older New York State Department of Transportation framework. Neither the statute nor the regulations define “national interest”, so the three prongs carry the whole decision.

Step 1: Qualify for EB-2 First

USCIS checks EB-2 eligibility before it reaches the waiver. If you fail this step, the petition is statutorily ineligible. You qualify in one of two ways:

  • Advanced degree: a U.S. master’s degree or higher, a foreign equivalent, or a bachelor’s degree plus five years of progressive post-degree experience in the specialty.
  • Exceptional ability: expertise significantly above what is ordinarily found in your field, shown with at least three of six evidence types, followed by a final merits review.

The six exceptional ability evidence types are an academic record, letters showing 10 years of full-time experience, a professional license, evidence of high pay, professional association membership, and recognition from peers or organizations. For an NIW, your area of exceptional ability must also relate directly to your proposed endeavor.

The occupation behind your endeavor must itself require at least a bachelor’s degree. USCIS gives the example of an engineer with a master’s degree versus a person with the same degree who plans to open a bakery.

Step 2: Define Your Proposed Endeavor

Write the endeavor as one specific paragraph before you gather any evidence. USCIS treats “endeavor” as narrower than “occupation”. In Dhanasar, the occupation was engineer, and the endeavor was research and development on air and space propulsion systems. List the projects, goals and field you will work in. Do not list generic job duties.

Prong 1: Substantial Merit and National Importance

Merit can sit in business, entrepreneurship, science, technology, culture, health or education. It does not need a quantified economic payoff. Research and pure science can qualify without one.

National importance is a separate test. It looks at the potential prospective impact of the work, not only its geography. A locally focused project can still qualify. The Policy Manual lists several arguments that do not work alone:

  • The general importance of a profession, such as classroom teaching.
  • A national shortage in your occupation.
  • Benefits that reach only a single employer or its clients.
  • The general value of entrepreneurs for job creation.

The Dhanasar petitioner’s teaching plans failed this prong because the record did not show broader impact on STEM education. His propulsion research passed. The AAO cited expert letters and congressional interest in hypersonic technology.

Prong 2: Well Positioned to Advance the Endeavor

This prong judges you, not the idea. USCIS weighs your education, skills and record of success in similar efforts. It also weighs a plan for future activities, progress already made, and interest from customers, users or investors. You do not have to prove the endeavor will succeed, but unsubstantiated claims fail.

Expert letters help most when the writer has first-hand knowledge of your work, gives specific examples, and is backed by independent evidence. Business plans need the same support.

Prong 3: Balance Favors the Waiver

The AAO lists three factors. First, whether a job offer or labor certification is impractical for you or your endeavor. Second, whether the U.S. would still benefit even if other qualified workers exist. Third, whether the national interest in your work is urgent enough to skip the labor certification process. The factors must point the same way when taken together.

The decision is also discretionary. Meeting all three prongs allows approval but does not require it.

Filing Steps for Self-Petitioners

  1. Confirm the EB-2 baseline. Gather your degree evaluation or your exceptional ability evidence.
  2. Write the endeavor statement. One paragraph, with specific projects and goals.
  3. Map evidence to each prong. Build one evidence folder per prong, with an exhibit list.

  5. File Form I-140. Check the USCIS I-140 page for the filing address and checklist. Include the employee portions of the labor certification form (ETA 9089), without Department of Labor approval.
  6. Decide on premium processing. File Form I-907 with the petition or later with your receipt notice.
  7. Plan for the green card stage. I-140 approval does not issue a visa number. Check the Department of State Visa Bulletin for your country’s EB-2 date.

USCIS says it will refund the premium fee if it takes no action within the window. Premium processing speeds up the I-140 decision only. It does not move your place in the visa queue.

  • National importance argued through shortage or employer benefit alone.
  • Recommendation letters that praise you in general terms and cite no specific results.
  • A plan with no supporting evidence of progress or outside interest.
